2. These terms
These terms and conditions govern your use of our website and any purchase you make from us. Please read them carefully. By using our website or placing an order, you agree to be bound by these terms.
You must be at least 18 years old to use this website or place an order.
These terms apply to consumers only — individuals purchasing for personal use. If you are purchasing for business or trade purposes, separate terms apply. Please contact us at info@cocofina.com.
3. Use of our website
All content on this website — including text, images, graphics, product descriptions and software — is owned by or licensed to Cocofina Limited and is protected by copyright and other intellectual property rights.
You may view and print pages for your own personal, non-commercial use only. You must not reproduce, modify, distribute or use any content from this website for commercial purposes without our prior written permission.
You must not use this website in any way that is unlawful, harmful, abusive, or that interferes with other users' enjoyment of it, or that damages or disrupts our systems.
We may suspend or restrict access to our website at any time without notice.
4. Your account
If you create an account on our website, you are responsible for keeping your login details confidential. You must notify us immediately if you suspect any unauthorised use of your account.
We may suspend or cancel your account if we have reasonable grounds to believe these terms have been breached.
5. Products and availability
All products displayed on our website are subject to availability. Product images are for illustrative purposes only. There may be minor variations in appearance between the image shown and the product delivered.
We reserve the right to change, withdraw or discontinue any product at any time without notice.
Natural variation in our products — including separation in coconut milk and cream — is a characteristic of additive-free, natural products and does not constitute a fault.
6. Ordering
Displaying products on our website is an invitation to treat, not a contractual offer. A legally binding contract is formed only when we send you an order confirmation by email.
You should check your order confirmation carefully and contact us immediately at info@cocofina.com if anything is incorrect. We are not responsible for errors in orders placed by you.
We reserve the right to refuse or cancel any order for any reason, including where a product is out of stock or where we suspect fraudulent activity. If we cancel a confirmed order for which you have already paid, we will refund you in full within 14 days.
7. Prices and payment
All prices shown on our website are in pounds sterling and include VAT at the applicable rate. Delivery charges are shown separately at checkout.
We reserve the right to change prices at any time. Price changes will not affect orders already confirmed.
Payment is taken at the time of ordering. We accept the payment methods shown at checkout. We do not store your card details.
If a product is incorrectly priced due to an error on our website, we are not obliged to supply it at the incorrect price and will contact you to offer the correct price or cancel your order with a full refund.
8. Delivery
We deliver to UK Mainland only.
We aim to dispatch orders promptly. Estimated delivery timescales are shown at checkout. In all cases we will deliver within 30 days of your order confirmation unless we notify you otherwise.
If we are unable to deliver within the agreed timescale you may cancel your order for a full refund.
If you fail to take delivery through no fault of ours, we may charge reasonable storage and redelivery costs.
Risk in the goods passes to you on delivery. Ownership passes to you only on receipt of full payment.
9. Your right to cancel
You have the right to cancel your order within 14 days of receiving your goods without giving any reason, subject to the exceptions below.
To cancel, contact us at info@cocofina.com within 14 days of delivery, quoting your order number. You then have a further 14 days to return the goods to us.
Exceptions — the right to cancel does not apply to:
- Goods that are liable to deteriorate or expire rapidly
- Sealed goods which are not suitable for return for hygiene or health protection reasons once opened
For the avoidance of doubt: unopened, shelf-stable products may be returned within the 14-day cancellation window. Opened food products cannot be returned for hygiene reasons, except where they are faulty or not as described.
10. Returns — change of mind
To return an unopened product, contact us at info@cocofina.com with your order number within 14 days of delivery. You are responsible for the cost of returning goods on change-of-mind returns.
Goods must be returned in their original, undamaged packaging and in a resaleable condition. We reserve the right to deduct an amount from your refund where goods have been handled beyond what is necessary to inspect them.
We will issue your refund within 14 days of receiving the returned goods, using the same payment method you used to order.
11. Faulty or damaged goods
If you believe your order has arrived damaged or faulty, you must notify us at info@cocofina.com within 48 hours of delivery, quoting your order number.
We require clear photographic evidence of each individual damaged or faulty item before we can assess any claim. Please include photographs of the outer packaging as well as the product itself.
On receipt and review of your photographs, we will assess the claim and, at our discretion:
- Arrange collection of the goods and issue a full refund
- Send a replacement at no charge
- Offer a partial refund where appropriate
We reserve the right to request the return of goods before issuing a refund. Where we arrange collection, we will cover the cost. Where we ask you to return goods independently, we will reimburse your reasonable return postage costs on receipt of the goods.
Nothing in this clause affects your statutory rights. If goods are confirmed as faulty or not as described, you are entitled to a full remedy under the Consumer Rights Act 2015.
12. Our liability
We do not exclude or limit liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited under applicable law
Subject to the above, to the maximum extent permitted by law, we are not liable for:
- Indirect or consequential losses
- Loss of profit, revenue, business or goodwill
- Losses arising from events beyond our reasonable control
13. Circumstances beyond our control
We are not liable for delays or failures caused by circumstances beyond our reasonable control, including but not limited to extreme weather, industrial action, or failure of third party suppliers or carriers. We will notify you as soon as possible and work to minimise any disruption.
14. Links to other websites
Our website may contain links to third party websites. We are not responsible for the content or privacy practices of those sites and do not endorse them.
15. Privacy and cookies
Your use of our website and any personal data you provide is governed by our Privacy Policy and Cookie Policy, which form part of these terms and are available at www.cocofina.com/pages/privacy-policy.
16. Complaints
We aim to resolve all complaints promptly and fairly. If you have a complaint, please contact us at info@cocofina.com or in writing to our registered address. We will acknowledge your complaint within 2 working days and aim to resolve it within 5 working days.
17. General
These terms constitute the entire agreement between you and us in relation to your purchase and use of our website, and supersede all previous agreements.
We may update these terms from time to time. Any changes will be posted on this page with an updated date. Your continued use of our website following any changes constitutes acceptance of the revised terms.
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.
No delay or failure by us to exercise any right under these terms will constitute a waiver of that right.
You may not transfer any of your rights under these terms to any other person without our written consent.
The Contracts (Rights of Third Parties) Act 1999 does not apply to these terms.
18. Governing law and disputes
These terms are governed by the law of England and Wales. Any disputes arising under these terms will be subject to the jurisdiction of the courts of England and Wales, except that customers residing in Scotland or Northern Ireland may bring proceedings in their local courts.
